Chapter 1: Regulation of Motor Vehicles

§2101. AUTHORITY

Under the authority granted in Title 23 VSA, Sections 1007 and 1008, and Title 24 VSA Sections 1971 and 2291(1) (4) and (5), Title 24 VSA Chapter 59 and such other general enactments as may be material hereto, the Selectboard of the Town of Wallingford hereby adopts the following civil ordinance concerning traffic control.

§2102. PURPOSE

The purpose of these regulations is to promote safety, to provide good traffic flow, and to assist the town in the maintenance of streets and highways.

§2103. DEFINITIONS

The definitions of Title 23 VSA, Section 4 are incorporated by reference.

§2104. TRAFFIC CONTROL DEVICES

(a)   It shall be unlawful for any person to disobey the direction of a traffic control device except in response to the direction of a law enforcement officer.

(b)   It shall be unlawful for any person to intentionally remove, injure, obstruct, deface, alter, or tamper with any traffic control device.

(c)   It shall be unlawful for any person to install any sign or device that may resemble or be mistaken for an official traffic control device without prior approval of the Wallingford Selectboard.

§2105. MAXIMUM SPEED

It is hereby declared, based upon engineering and traffic investigation, that the prima facia speed limit shall be:

US Route 7 North A maximum speed of 30 m.p.h. from the intersection of VT Route 140 for 0.35 miles north to a point 150 feet north of TH #3, and then 35 m.p.h. for a distance of 0.45 miles to a point 150 feet north of the intersection of TH #75, and then 45 m.p.h. for a distance of 0.55 miles north to a point 200 yards north of the fork in US Route 7, these zones being consistent with the current state speed zones.
US Route 7 South A maximum speed of 30 m.p.h. from the intersection of VT Route 140 for 0.50 miles south to a point 150 yards north of TH #68, and then 40 m.p.h. south for 0.55 miles to a point 100 yards north of TH #14, these zones being consistent with the current state speed zones.
T.H. #1 A maximum speed of 25 m.p.h. from the intersection of US Route 7 westerly for .30 miles to a point approximately 505 feet east of the Elfin Lake Road, then a  maximum speed of 40 m.p.h. to the Tinmouth Town Line.
T.H. #2 A maximum speed of 35 m.p.h. from the crossing of Otter Creek to the Clarendon Town Line.
T.H. #5 A maximum speed of 35 m.p.h. from the intersection of T.H. #1 southerly to the intersection of T.H. #47, then a maximum speed of 35 m.p.h. from T.H. #47 to the intersection of T.H. #49.
T.H. #6 A maximum speed of 35 m.p.h. from the intersection of Vermont Route 140 extending easterly a distance of 3.50 miles, then a maximum speed of 25 m.p.h. from 3.50 mile east of Vermont Route 140 to intersection of Vermont Route 140.
T.H. #7 A maximum speed of 30 m.p.h. for its entire length.
T.H. #8 A maximum speed of 35 m.p.h. from the intersection of US Route 7 to the Clarendon Town Line.

The above speed limits shall be posted in accordance with the standards set forth in the Manual of Uniform Traffic Control Devices and shall be in effect when so posted.

§2106. UNLAWFUL SPEED

It shall be prima facia unlawful for any person to drive a vehicle at speeds in excess of applicable State Traffic Laws.  It shall be further prima facia unlawful for any person to drive a vehicle at speeds in excess of any speed declared in or in accordance with this Chapter.

§2107. THROUGH STREETS

The following described highways, and all parts or portions thereof lying within the Town of Wallingford, Vermont are hereby declared to be through streets for the purpose of this ordinance.

1.      U.S. Route #7

2.      Vermont Route #140 East

3.      Vermont Route #103

4.      Vermont Route #155

§2108. AUTHORITY TO ERECT STOP AND YIELD SIGNS

Whenever any ordinance designates and describes a through street, it shall be the duty of the Selectboard to place and maintain a stop or yield sign on each and every street intersecting such through streets or intersecting that portion thereof described and designated as such by any ordinance of this Town, unless traffic at any such intersection is controlled at all times by traffic-control signals, provided, however, that at the intersection of two such through streets or at the intersection of a through street and a heavy traffic street not designated as a through street, stop or yield signs shall be erected at the approaches of either of said streets as may be determined by the Selectboard.

§2109.  INTERSECTION WHERE STOP OR YIELD REQUIRED

The Selectboard is hereby authorized to determine and designate intersections where particular hazard exists upon other than through streets and to determine whether vehicles shall stop or yield the right of way at one or more entrances to any such intersection, and shall erect a stop or yield sign at every such place where a stop or yield of right of way is required.

(a)     The following intersections shall be designated as “STOP” intersections, and shall be so signed:

§2110. SIGNS TO BEAR THE WORD “STOP” OR “YIELD”

(a)     Every stop sign erected pursuant to this Chapter shall bear the word “STOP” in letters not less than eight (8) inches in height, and such sign shall at nighttime be rendered luminous by efficient reflecting elements on the face of the sign.  Every stop sign shall be located as near as practicable at the nearest line of the cross walk on the near side of the intersection or, if none, at the nearest line of the through street.

(b)     Every yield sign erected pursuant to this Chapter shall bear the word “YIELD” in letters not less than eight (8) inches in height, and such sign shall at nighttime be rendered luminous by efficient reflecting elements on the face of the sign.  Every yield sign shall be located as near as practicable at the nearest line of the cross walk on the near side of the intersection or, if none, at the nearest line of the through street.

§2111. VEHICLES TO STOP AT STOP SIGNS – YIELD AT YIELD SIGNS

When stop or yield signs are erected as herein authorized at or near the entrance of any intersection, every driver of a vehicle shall stop or yield, as the case may be, in accordance with the provisions of 23 VSA §1048.

§2112. EMERGING FROM ALLEY, DRIVEWAY, OR BUILDING

The driver of any vehicle within a business or residence district emerging from an alley, driveway, or building shall stop such vehicle immediately, prior to driving onto a sidewalk area extending across any alleyway or driveway, yielding the right of way to any pedestrian as may be necessary to avoid collision and, upon entering the roadway, shall yield the right of way to all vehicles on said roadway.

§2113. STOP WHEN TRAFFIC OBSTRUCTED

No driver shall enter an intersection or a marked cross walk unless there is sufficient space on the other side of the intersection or cross walk to accommodate the vehicle he/she is operating without obstructing the passage of other vehicles or pedestrians not withstanding any traffic-control signal indication to proceed.

§2114. OBEDIENCE TO SIGNAL INDICATING APPROACH OF RAILROAD TRAIN

(a)   Whenever any person driving a vehicle approaches a railroad grade crossing under any of the circumstances stated in this Section, the driver of such vehicle shall stop within fifty (50) feet but not less than fifteen (15) feet front the nearest rail of such railroad, and shall not proceed until he can do so safely.  The foregoing requirements shall apply when:

(1)     A clearly visible electric or mechanical signal device gives warning of the immediate approach of a railroad train;

(2)     A crossing gate is lowered or when a human flagman gives or continues to give a signal of the approach or passage of a railroad train;

(3)     A railroad train approaching within approximately fifteen hundred (1,500) feet of the highway crossing emits a signal audible from such distance and such train, by reason of its speed or nearness to such crossing, is an immediate hazard;

(4)     An approaching railroad train is plainly visible and is in hazardous proximity to such crossing.

(b)     No person shall drive any vehicle through, around, or under any crossing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being opened or closed.

§2115. U TURNS PROHIBITED

It shall be unlawful for the driver of any vehicle traveling or parking within or adjacent to the right of way of any street, road, or highway within the Town of Wallingford to turn such a vehicle within said right of way so as to cause said vehicle to proceed in the opposite direction.

§2116. PENALTIES

A violation of this chapter is a Vermont Traffic Complaint. The fines for violations of these sections shall be as defined by the current schedule of fines of the Vermont Justice Bureau.

§2117. ENFORCEMENT

The Constables of the Town of Wallingford shall be the chief enforcement officers of this ordinance. The Selectboard may appoint a Municipal Enforcement Officer to assist in the enforcement of this ordinance.

§2118. SEVERABILITY

Each of the provisions of this ordinance is severable and if any provision is held invalid for any reason, the remaining provisions shall not be affected but shall remain in full force and effect.

§2119. EFFECTIVE DATE

This ordinance shall become effective sixty days after its adoption by the Wallingford Selectboard. If a petition is filed under 24 VSA 1973, the taking effect of this ordinance shall be governed by that statute.
