Ordinance Regarding Flammable Gases

CHAPTER 2:  FLAMMABLE GASES

§3201.  DEFINITIONS

For purposes of this Chapter, the following definitions shall apply:

a)  Flammable gas – Flammable gas shall mean any propane, bottled gas, liquefied petroleum gas, or other flammable gaseous material commonly used for domestic or commercial heating or cooking purposes, or for industrial purposes.

b)  Dealer – Dealer shall mean any natural person, corporation, proprietorship, partnership, or any other business organization engaged in the retail or wholesale sale, distribution, storage, transportation, or collection of any flammable gas.

c)  Container – Container shall mean any bottle, vessel, tank or other receptacle used for the collection, storage, sale, delivery, distribution or transportation of a flammable gas.

§3202.  STORAGE OF FLAMMABLE GASES

The storage, collection or maintenance of flammable gas or container of flammable gas by any dealer except within a properly supervised or locked enclosure, sufficiently secure to prevent unauthorized access to or tampering with said flammable gas or containers, is hereby declared to be a public hazard and is prohibited.

§3203.  IMPOUNDING CONTAINERS

In addition to any other penalties provided under this Revision, the Selectmen of the Town of Wallingford are hereby authorized to remove and impound any container found in violation of this Chapter, and to charge the owner or proprietor of such container a reasonable fee for removal and storage thereof, not to exceed Five Dollars ($5.00) for each container removed and One Dollar ($1.00) per day per container for storage, provided that the Selectmen shall, as soon as practicable, advise the owner or proprietor of said container of its removal and storage. Such container shall be returned to said dealer only upon payment of all removal fees, storage fees, and fines assessed hereunder, and under these Ordinances.
