Ordinance Regulating Snowmobiles

CHAPTER 3:  SNOWMOBILE REGULATIONS

§3301.  ORDINANCE APPLICABLE

The laws of the State of Vermont shall apply in all instances not covered by this Chapter, provided that the provisions of this Chapter shall be applicable to all snowmobiles operated within the Town of Wallingford, Vermont except as otherwise declared and determined by the laws of this State.

§3302.  EFFECT OF REGULATION

a)      It shall be a violation of this Revision for any person to do any act forbidden or fail to perform any act required in this Chapter.

b)      The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this Chapter.

c)      These regulations applicable to snowmobiles shall apply whenever a snowmobile is operated upon any street, road, or highway, whether State, Town, or otherwise, within the Town of Wallingford.

§3303.  TRAFFIC LAWS APPLY TO SNOWMOBILES

Every person riding a snowmobile upon a street, road or highway shall be granted all rights and shall be subject to all of the duties applicable to the driver of any vehicle by the laws of the State, by this Revision, and by any other ordinances from time to time declared by the Town of Wallingford, except as to special regulations in this Chapter and except as to those provisions of law and ordinance which by their nature can have no application.

§3304.  RIDING ON ROADWAYS

Every person operating a snowmobile upon a street, road or highway shall operate said snowmobile in single file, as near to the right hand side of the highway as practicable, exercising due care when passing a standing vehicle, provided that it shall be unlawful for a snowmobile to pass to the left of a moving automobile upon any street, road, or highway.

§3305.  RIDING ON CERTAIN STREETS PROHIBITED

Except when crossing the following streets in accordance with Section 3307 of this Chapter, it shall be unlawful for any person to operate a snowmobile for any purpose, for any distance upon School Street, Depot Street, North Main Street, South Main Street, or Railroad Street, all within Fire District No. 1 of the Village of Wallingford.

§3306.  OPERATION ON STREETS AND HIGHWAYS

a)   Subject to the limitations of Section 3305 of this Chapter, and except as hereinafter provided, it shall be unlawful for any person to operate a snowmobile upon any regularly plowed street, road, or highway, except for the purpose of traveling from one snowmobile trail to another, provided that in no event shall any person operate a snowmobile upon any regularly plowed street, road, or highway for a distance in excess of two-hundred fifty (250) feet.

b)  Snowmobiles may be operated without limitation as to distance, upon Town Highway No. 6 from Route 140 East to the intersection of Town Highway No. 51, bridge at intersection of Route 103 and School Street in the Village of East Wallingford, and upon Church Street, when and where signs are erected by order of the Selectmen designating a portion or portions of said highways as snowmobile trails.

§3307.  CROSSING HIGHWAYS

It shall be unlawful for a person to cross a highway on a snowmobile except in the following manner:

a)   The crossing shall be made at approximately right angles to the direction of traffic on the street or highway, and;

b)   The Snowmobile shall be brought to a complete stop before entering the traveled portion of the highway, and;

c)   The driver of the snowmobile shall yield the right of way to all motor vehicles approaching on the highway, and;

d)   All of the pertinent provisions of this Chapter and all other applicable ordinances and laws shall be observed.

§3308.  SPEED

It shall be unlawful for any person to operate a snowmobile upon any regularly plowed highway within the Town of Wallingford at a speed in excess of ten (10) miles per hour.
