called the hearing to order.
John West
made a motion to approve the minutes from the hearing on August 27th,

2nd. Passed by all.
Public Hearing for Tom and Kimberly Phillips
Permit # 09-25
3 lot subdivision, removal of 5- 10,000 yards to flatten lot and removal of
overburden.
70 Waldo Lane,
Wallingford,
Vermont
Purpose:
To complete original permit due to expire October 24, 2009
Interested parties sworn in.
Facts: Map submitted does not show how the property will be
subdivided or where the access to the properties is located. Topographical map
submitted was outdated. Interested parties wanted a maps submitted to show the
contours of the site in it’s present state and contours after the site is
developed.
Objections:
Interested parties objected to extraction in the Zoning
District FRR in which it is stated in the Zoning Regulations this is not a
permitted use. The abutters had concerns with noise and traffic that would be
continuing.
Mr. Phillips stated he is simply trying to get his property
ready to be considered a buildable site.
Public Hearing for James Edmunds
Property located at 15 South Main Street
Permit #09-26
Purpose:
To add 25 seats for dining, a handicap accessible bathroom
and a handicap ramp to the building.
Facts: There would be no increase to the size of the
building. The indoor renovations are to accommodate larger groups. A copy of the
permit would need to be given to the Wallingford Fire District due to the
additional seating. Mr. Edmunds stated he has plenty of parking available.
Objections: None
The Public Hearing was closed at

and the Board entered deliberative session.
