Chair Bill Scranton opened the meeting at 6:30 P.M.  

1.         Welcome New Member – Larry Miller  

Larry Miller attended the meeting this evening and was welcomed. Ed Crelin was not able to accept the appointment to the Planning Commission at this time due to out-of-town commitments.  

2.         Mark Blucher – Orton Foundation CommunityViz Project  

a)         Mark provided a handout of the project’s scope and work accomplished to date. The Town received a Municipal Planning Grant of $14,990 in September 2006 for the project. The project would result in a build-out projection on how the Village of Wallingford would look in the next 20 years. Rutland Regional Planning Commission did some initial work and met with some local people informally. The mid-term report to the State is due and the project must be completed by May 2008.  

In order to complete the project, a working group of five people from town; one Selectboard member, one Planning Commission member and three others must be formed in the next couple of weeks. This group would meet with RRPC to provide input regarding interpretations of the zoning regulations and assumptions concerning future development. If a group cannot be formed in the immediate future, the Town should inform the State that the project has ended and the rest of the grant money will not be needed.  

The Planning Commission feels that this is still a worthwhile project and will try to determine some interest in various individuals. Jay Kenlan was the PC member who did the most toward getting the grant for this project. Our next meeting on October 8th will be our deadline for providing a list of names.  

b)         Mark also talked about a Municipal Planning Grant that RRPC received to provide training to local officials on Zoning and Planning issues and Roles and Responsibilities. Sort of a Zoning 101 class. All the members of the Planning Commission expressed interest in attending such training.  

c)         Rutland Regional has received a series of maps from the State showing the old Flood Hazard areas and the New Flood Hazard areas. They also have a list of properties that were in the old flood areas but are not in the new ones, and properties that are in the new flood areas that were not in the old ones. This should be available on the web.  

Mark recommended sending our new Zoning Regulation document to the new National Flood Insurance Program Coordinator, Ron Evans, to ask if it is compliant with Federal requirements.  

3.         Review and approval of meeting minutes of August 13, 2007  

John West moved and Bob Soule seconded approval of the minutes of August 13, 2007 . Motion carried 5-0 with Larry Miller abstaining.  

4.         Old Business – review of new Zoning Regulation  

Missy Whitmore has compiled all of the changes made based on the memo from the Selectboard requesting definitions and clarifications. The Zoning Administrator will send a response to the Selectboard along with the latest version of the document.  

One item needing clarification is on page 27 in Section 310 regarding Flood Hazard regulations. In 310.14 Definitions; Cumulative Substantial Improvement regarding improvements made during a 3 or 4 or 5 year period. The Planning Commission unanimously agreed to use three years.  

Bill Brooks moved and John West seconded approval of the new Zoning Regulation modified as of September 10, 2007 . Motion carried 6-0.  

5.         Other Business  

Dennis Smith spoke about the work happening on Karen Lamay’s house on Route 7 South. He said that her permit did not cover the work being done. He feels it is not fair that he has had to notify abutting landowners and she did not. Bill Brooks responded as Zoning Administrator that in response to Mr. Smith’s letter to the ZA he has looked at the file and the notes and minutes from the Planning Commission site plan review meeting of October 2005, and also from the memory of that meeting, and determined that the work being done is okay under that permit. Mr. Smith also mentioned that the “Big Red P” sign only recently appeared in her window. Bill Brooks responded that he had just given her one because they didn’t exist at the time the permit was granted. The only notice of the permit at that time would have been a copy posted in the Town Hall and Post Office.  

Ann Tiplady said that she is still interested in serving on the Planning Commission. We said we would welcome her as a new member. She will write a letter of interest to the Selectboard.  

6.         Adjournment  

Larry Miller moved and John West seconded to adjourn at 8:00 p.m. Motion carried 6-0.  

Next Meeting:  October 8th at 7:00 PM
