Chair Bill Scranton opened the meeting at 7:05 P.M.  

1.         Review and approval of meeting minutes of October 8, 2007  

Bob Soule moved and John West seconded approval of the minutes of October 8, 2007 . Motion carried 6-0.  

2.         Site Plan Review – Dennis Smith – Route 7 South  

Mr. Smith has registered an appeal with the Environmental Court on the decision of the Zoning Board of Adjustment and the site plan review done by the Planning Commission. The ZBA’s decision said that by forwarding the matter to the ZBA the PC had found the use to be of the same general character for the area and the ZBA granted his conditional use request. It was noted in our discussion that having a Development Review Board in town would simplify these kind of situations giving the applicant one place to go for a decision.  

3.         Site Plan Review – “Nail It Down” Hardware Store renovations  

Bill Brooks showed pictures of the renovations that have been completed at the former Edmunds Hardware store, enclosing the front “porch” area for lumber and plywood storage. Mr. Esposito, the new owner, had not been aware of the Town’s permit requirements and was happy to submit the appropriate paperwork. Missy Whitmore moved approval of the site plan as constructed. Bob Soule seconded. Motion carried 6-0.  

4.         Old Business / Other New Business  

            a.         Larry Miller developed some language to go into the Small Lot Exemption section on page 60 as follows:  

            Under this section existing small lots are only exempt from lot size, lot depth and lot width (frontage) requirements and not from setbacks or any other dimensional requirements, including percentage of coverage mandates of the zoning regulations.  If any of these non-exempt requirements cannot be met, a variance is required for existing small lot development.  

He also suggested adding language in section 1204.3.1 regarding the scope of an application:  

            All applications shall be submitted in such detail as to enable the Administrative Officer or Appropriate Municipal Panel to comprehend the scope and extent of the requested development.  The Administrative Officer or Appropriate Municipal Panel may request additional detail and/or information that is reasonably necessary to accomplish the purpose of this section.  

Larry also suggested adding a line on the application form requesting the recorded Book and Page number from the land records. This would provide the source of the title of the parcel under discussion.  

            b.         Bob Soule recommended adding the word “the” to help clarify the statement being made in the definition of “Survey” found on page 11-12.  

            While the Administrative Officer, or Appropriate Municipal Panel, should endeavor to minimize the burden on the applicant to the extent reasonable possible, the Administrative Officer, or Appropriate Municipal Panel, shall have the discretion to require such level of        detail and accuracy as they, in their reasonable judgment, deem necessary to satisfy the particular provision of these Zoning Regulations that is THE subject of the application.   

            c.         Bill Scranton reported on his meeting with the Selectboard. They voted to set the number of Planning Commission members at seven. He offered to hold a joint meeting with them to go over any questions that remain about the new Zoning regulation.  

            d.         Bob Soule spoke about the Orton Foundation grant. He has gathered a group of people together including himself, Dick Savery, David Klock, Ralph Nimtz, and Missy Whitmore. He has contacted Mark Blucher of Rutland Regional Planning Commission and Mark will help with what is needed to complete the project.  

e.         Ms. Best presented a list of the properties along Route 7 South in the Rural Otter Creek Valley Multiple Resource Area and the permitted, conditional and in-home uses at some of them that she feels are not in keeping with the general character of this rural area.  

5.         Adjournment  

Larry Miller moved to adjourn at 7:45 PM. John West seconded. Motion carried 6-0.
