Frederick & Beth Sheehe, Kevin & Michele Mulholland, Dennis Smith, and
Jill Burkett for Ira Frederick’s Application #07-01.
Chair Larry Miller called the meeting to order at
7 p.m.
and read the warning for the Frederick Application.
Prior to reviewing the application, the Board members
discussed the Interim Zoning By-Law and the Proposed Zoning Regulations and its
authority to hear this application. It
was determined that the Zoning Board still has the authority to hear this
application.
1.
Ira Frederick, Application #07-01, for a permit to place a mobile
home in the 100 year (A7) flood plain.
Mr. Frederick was sworn in.
Submitted with the completed
application were the following:
-
a sketch of the lot showing the property lines,
-
the location of the mobile home with setback distances, north arrow, and
scale;
-
a letter submitted to Ms. Torizzo of the VT ANR River Management Program
dated January 10, 2007 from the Zoning Administrator as required by the Flood
Plain Regulations; and
-
an Elevation Certificate completed by Raymond Page, Land Surveyor with
SVE Associates; a survey of the parcel showing flood hazard areas.
Submitted at
the hearing were the following:
-
a State of
Vermont
Potable Water Supply and Wastewater System Permit (WW-1-1548);
-
a response from the VT ANR River Management Program dated
February 6, 2007
stating the need for more information from the engineer; and
-
a survey of the property showing the flood hazard areas, the proposed
location of the mobile home, and setbacks.
The Board members discussed the
letter from the VT ANR and the Water and Waste Water Permit.
Considering the VT ANR’s need for more information, the Board discussed
waiting until the VT ANR received
its additional information and submitted a final status letter; and that Mr.
Frederick submit a response to the conditional use criteria.
The motion was made and seconded to recess the hearing to
February 21, 2007
,
7 p.m.
, at the Town Hall pending receipt of a
final status letter from the VT ANR and responses to the conditional use
criteria.
Motion carried 5-0.

Review and Approval of the July 6 and
September 12, 2006
Meeting Minutes:
Jay moved and John seconded to approve the Minutes of July 6 and
September 12, 2006
as submitted.
Motion carried 4-0 (Hans abstained)
3.
Other:
The Board members discussed the status of the ZBA and the proposal to
replace the ZBA with the Development Review Board (DRB).
It was noted that the Selectboard must first approve the Proposed Zoning
Regulations. The members of the ZBA
could be requested to become DRB members.
The Board members also discussed the Interim Zoning By-Law and the need
for the ZBA.

Jay moved and Hans seconded to adjourn the meeting at
8:05
p.m.
