Present:  Bill Lohsen, Bill Brooks, Charlie Angel, Frank Bruce, Joan Crowley, and Julie Sharon  

The special meeting was called to order by Chair B. Lohsen at 10:20 a.m.  

B. Lohsen made a motion to move to executive session at 10:20 a.m. to discuss legal issues, joined by Julie Sharon; motion seconded by B. Brooks.  (Motion carried 5-0).  

The Selectboard came out of executive session at 11:15 p.m.   In executive session, the Selectboard reviewed and answered all of the claims in a new lawsuit filed by Melissa and David Whitmore, Plaintiffs, v. Thomas Phillips, Kimberly Phillips, Town of Wallingford, William Brooks, William Lohsen, and Amy Loomis, Defendants.  

C. Angel made a motion for all the Town of Wallingford parties named in the complaint to sign the Reservation of Rights issued by the law firm of McKee, Giuliani & Cleveland, who is coverage counsel to the VLCT Property and Casualty Intermunicipal Fund.  Motion seconded by F. Bruce.  Motion carried (5-0).  

F. Bruce and B. Lohsen apprised the Selectboard that Lawrence White of Lawrence White Construction in Danby has shown interest in extracting material from the Waldo Lane properties owned by the Town of Wallingford and Tom and Kim Phillips.  Mr. White also expressed the desire to gift sand to the Town over a four to five year period, with the Town possibly receiving the Phillips land at the end of the project.  This offering could save the Town thousands in dollars for winter sand expense.  

The meeting adjourned at 11:45 a.m.
