Present:  Bill Lohsen, Charlie Angel, Gene Gilman, Christine Davenport, Frank Bruce, and Julie Sharon

 

Visitors:  Joyce Barbieri, Sandi Switzer, Dick Landon, Dennis Smith, Tom Phillips, Carol Macleod, Tom Fuller, Bill Scranton, Debbie Scranton, Missy Whitmore , David Whitmore, and Ralph Nimtz  

Minutes.    The minutes of March 19th were approved on a motion made by G. Gilman, which was seconded by C. Angel.  Motion carried (5-0).  The minutes from the special meeting of March 27th were approved on a motion made by C. Angel and seconded by B. Lohsen.  Motion carried (3-0-2), with G. Gilman and C. Davenport abstaining.  

Selectboard Orders.  F. Bruce moved to approve pay orders totaling $16,939.72, which were increased by $7.50 for payment to the Vermont State Treasurer for marriage licenses; motion seconded by C. Angel.  Motion carried (5-0).  

Annual Appointments.  B. Scranton requested that the Planning Commission interview potential candidates for Jay Johnstone’s vacancy.  Bob Soule and Missy Whitmore ’s appointments are up, and B. Lohsen stated the Selectboard still has yet to discuss the establishment of a Development Review Board.  B. Lohsen moved to appoint Missy Whitmore and Bob Soule to the Planning Commission.  F. Bruce seconded the motion.  Motion carried (5-0).  

Richard Landon expressed interest in the Road Commissioner position and provided advice on a few road situations.  B. Lohsen thanked Mr. Landon, stating the Selectboard was happy with F. Bruce.  B. Lohsen made a motion to appoint F. Bruce as Road Commissioner; motion seconded by G. Gilman.  Motion carried (4-0-1).  F. Bruce abstained.  

Act 250 Permit Decision – Tom Phillips.  Application #1R0797-2 filed by Thomas and Kimberly Phillips, the Town of Wallingford and Fuller Sand and Gravel, Inc. to extract gravel at the gravel pit adjacent to Waldo Lane was denied by the District Environmental Commission #1.  Mr. Fuller believes that the Route 140W Bridge was the number one reason for denial.  There was a lengthy discussion on what steps must be taken to address these issues by either filing a notice of appeal or application for reconsideration with the District Commission. DuBois & King may be able to offer an independent report on the bridge’s condition to counter the report submitted to the Commission.  The traffic on the bridge, the vulnerability of the water line on the bridge, speed limits and other issues were discussed.  Mr. Phillips asked what people want done with the pit now owned by the town.  The Whitmore’s spoke as to their reasons for objecting to the project.  B. Scranton chastised Mr. Phillips for not contacting the Planning Commission to discuss the project.  G. Gilman felt the Selectboard provided its support; however, opposition is part of the Act 250 process.   

Scholarship Committee Representative.  F. Bruce agreed to continue serving as the Selectboard representative.  The appointment was approved on a motion made by B. Lohsen, and seconded by C. Davenport.  Motion carried (4-0-1) with F. Bruce abstaining.  

Mowing Bids.  Two bids were reviewed for the mowing of the recreation field, town hall and the West Hill, Sugar Hill, and Pelsue cemeteries. B. Lohsen moved to approve the lower bid submitted by Red Pine Service; motion seconded by C. Angel. Motion carried (5-0).   

VTrans 2006 Bridge Inspection Reports.  The Selectboard reviewed and accepted by consensus the inspection reports prepared by the Vermont Agency of Transportation on seven bridges in Wallingford .  All town-owned bridges, over 20 feet in length, are inspected on a two-year cycle.  

Wallingford Lodge a/k/a the Boy’s Camp.  Following up on the article voted on at Town meeting, the Selectboard reviewed the response from the Department of Taxes concerning the exemption of taxes on the Boy’s Camp.  Their ruling states that the town has no authority to exempt the property for municipal or education taxes under 32 V.S.A. §3659.  Therefore, the Prudential Committee will be put on notice that the property will be given an assessed value by Vermont Municipal Assessor and taxed.  The Prudential Committee will have to contest this ruling with the Tax Department.  

Quarterly Financials.  J. Barbieri reviewed the quarterly financials and anticipates finishing fiscal year 07 in the black for the 20th straight year.  There was discussion concerning the Fire District’s plan to begin collecting fire protection taxes.  J. Barbieri read the agreement between the Town and WFD #1 that states that the Town will collect the taxes.  

Other Business/ Ann ouncements.  The Selectboard acknowledged the 2/26 Conservation Commission minutes, and Roy Morgan notice to resign as Lister without taking office.  

There was a brief discussion regarding the Dennis Smith case.  Mr. Smith was found in violation of the zoning laws by changing the use of his Route 7 property without a permit, and was found in violation of the flood plain ordinances by dumping fill within the floodway without a permit.

Other Business.  The Selectboard acknowledged an article on the Planet Aid organization. Wallingford Fire District #1 is requesting that the Town patch the areas on Meacham and Prospect Streets and bill them, to which the Selectboard agreed to by consensus.  Speaking on behalf of Fire Chief Warren Allen, Julie reported that there was a grass fire in the pit on Sunday; therefore, he opted to burn the entire property.  There was discussion concerning the Fire Department’s truck purchase proposal.  It was recommended that the fire needs of the community be determined in order to ascertain they have the proper number of trucks.  

B. Lohsen made a motion to move into executive session to discuss personnel; motion seconded by F. Bruce.  (Motion carried 5-0).  Board members entered Executive Session at 8:45 p.m. and were joined by J. Barbieri and J. Sharon .  The Selectboard came out of executive session at 9:10 p.m.     

The meeting adjourned at 9:10 p.m.
